Terms of Service

1. Welcome to Birenko

Birenko is an organization management platform that helps teams manage events, tasks, documents, meetings, and collaboration. These Terms of Service ("Terms") govern the use of the platform.

Birenko is operated by HODURAK (David Sabo PR, sole proprietor), registered at Braće Jugovića 9/17, 24000 Subotica, Serbia (Tax ID: 115475776, Reg. number: 68394856).

By logging into the platform or setting a password, the User agrees to these Terms and our Privacy Policy. If the User does not agree, the User must not use the platform.

The platform is currently in beta and available free of charge. During the beta period, features may change, expand, or be discontinued. We reserve the right to introduce paid subscription plans after the beta period ends, with reasonable advance notice. Free access during the beta period does not create any entitlement to continued free service beyond the beta.

2. Definitions

  • "Platform": the Birenko web application, accessible at birenko.com and its subdomains
  • "Organization": a group or entity created within Birenko, with its own subdomain
  • "User": any person who accesses or uses the platform, including but not limited to Admins, organization members, and any other individuals who log in
  • "Admin": an organization administrator who manages users and configures settings. Admins are Users and are bound by all User obligations in addition to their administrative responsibilities
  • "Content": any data, text, files, or materials uploaded or created by users
  • "We", "us": HODURAK, the operator of Birenko

3. Account and Security

The User is responsible for keeping login credentials secure. We store passwords using industry-standard encryption, never in plain text. If the User suspects unauthorized access to their account, they must notify us immediately at support@birenko.com.

4. Communications

By using the platform, the User agrees to receive service-related notifications, including:

  • Transactional notifications (task assignments, event updates, chat messages, and other platform activity)
  • System notifications (maintenance notices, security alerts, account-related updates)
  • Push notifications (if enabled by the User in their browser or mobile application)

These notifications are necessary for the operation of the service and do not constitute marketing communications. The User may disable push notifications at any time through device or browser settings.

5. Organizations and Administrator Responsibility

Birenko is a multi-tenant system. Each organization has its own data, members, and settings, fully isolated from other organizations.

Organization administrators:

  • May create user accounts by entering names and email addresses
  • Warrant that they have a lawful basis for entering members' personal data (e.g., employment relationship, membership, consent, or legitimate interest)
  • Act as data controllers for the personal data within their organization

Birenko acts as a data processor on the organization's instructions. See our Privacy Policy for details.

By using the platform as an organization, the Organization accepts the Data Processing Agreement, which forms an integral part of these Terms and governs how Birenko processes personal data on the Organization's behalf.

5.1 Tax and Regulatory Compliance

The platform provides organizational tools including ticket generation, participant management, budgeting, and other features. These tools are provided solely for organizational purposes and do not constitute a cash register, fiscal system, accounting software, or tax advisory service.

The organization and its administrators are solely responsible for:

  • Complying with all applicable tax, fiscal, and regulatory obligations (including but not limited to VAT, income tax, local taxes, and fiscal receipt requirements)
  • Maintaining proper records of ticket sales, revenues, and financial transactions as required by applicable law
  • Issuing fiscal receipts or invoices where required by local regulations

Birenko bears no responsibility for organizations' tax obligations, regulatory compliance, or any consequences resulting from non-compliance with applicable financial regulations.

6. Acceptable Use

The User must use the platform lawfully and respect the rights of others. The User may not:

  • Distribute spam, malware, or illegal content
  • Attempt to access other users' accounts or data
  • Circumvent the platform's security measures
  • Use the platform in violation of applicable laws

6.1 Prohibited Content

The following content is strictly prohibited on the platform, whether uploaded privately or published publicly (including blog posts, attachments, and any other materials):

  • Child sexual abuse material (CSAM) or any sexualized depiction of minors
  • Non-consensual intimate imagery
  • Content that promotes terrorism, violence, or incites hatred against protected groups
  • Content that infringes on third-party intellectual property rights (copyright, trademarks)
  • Fraudulent, deceptive, or misleading content designed to harm others
  • Any content that violates applicable local, national, or international law

6.2 Content Moderation and Takedown

Birenko acts as a hosting platform. Organizations are solely responsible for the content they create and publish. However, we reserve the right to:

  • Remove or disable access to any content that violates these Terms, without prior notice
  • Suspend or terminate the offending user account and/or organization
  • Report illegal content to the relevant law enforcement authorities, including providing user and organization data as required by law

Discovery of CSAM or content depicting the exploitation of minors will result in immediate removal, account termination, and reporting to law enforcement without exception.

6.3 Reporting Abuse

Users who encounter content that violates these Terms should report it immediately to abuse@birenko.com. We aim to review all reports within 48 hours.

7. Publicly Published Content

Organizations may publish content publicly through features such as blogs, newsletters, and embeddable widgets. This content is accessible without authentication and may be indexed by search engines.

  • The publishing organization is solely responsible for the content it makes public, including compliance with applicable laws and third-party rights
  • Birenko does not pre-screen or endorse publicly published content
  • Publicly published content is served under the birenko.com domain; Birenko reserves the right to remove any public content that violates these Terms or may cause legal liability

8. User Content and Intellectual Property

User data belongs to the User. Period.

The User grants us a limited, non-exclusive license solely to the extent necessary to provide the service (e.g., displaying content, creating backups). We do not use User content for advertising, resale, or AI model training.

After account deletion, we retain User data for up to 30 days for backup purposes, then permanently delete it.

Following account deletion, we may retain anonymized and aggregated data derived from platform usage for statistical and service improvement purposes, as described in our Privacy Policy. Anonymized data cannot be linked back to any individual and is not considered personal data.

9. AI Features

Birenko offers optional AI features (powered by the Groq LLM service). When using these features:

  • User prompts are processed by Groq to generate responses
  • AI outputs are informational and provided "as-is"
  • The User is responsible for reviewing and validating AI-generated content before acting on it

10. Third-Party Services

The platform integrates with third-party services to provide functionality (e.g., Google Calendar sync, Groq AI service, push notification services). When using these integrations:

  • Third-party services are governed by their own terms of service and privacy policies
  • Birenko is not responsible for the availability, accuracy, or performance of third-party services
  • Disruptions or changes in third-party services may affect platform functionality beyond Birenko's control

11. Service Availability

We aim to provide reliable service, but we do not guarantee 100% uptime. The platform is provided on an "as-is" and "as-available" basis. We will provide advance notice of planned maintenance whenever possible.

12. Limitation of Liability

To the fullest extent permitted by law, the total liability of Birenko, its operator, employees, contractors, and affiliates shall not exceed the fees actually paid by the User in the 12 months preceding the claim.

None of the aforementioned parties shall be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or loss of business opportunity.

This limitation does not apply to willful misconduct or gross negligence.

13. Warranty Disclaimer

The platform is provided "AS-IS" and "AS-AVAILABLE," without any express or implied warranties. We do not guarantee accuracy, completeness, continuous availability, or fitness for a particular purpose.

This disclaimer does not affect the User's inalienable rights under applicable consumer protection laws.

14. Indemnification

The User agrees to indemnify Birenko, its operator, employees, contractors, and affiliates against any claims, damages, and costs arising from the User's uploaded content or the User's violation of these Terms.

15. Termination and Data Export

The User may delete their account at any time. Upon termination:

  • We will provide the User's data in an exportable format upon request
  • User data will be permanently deleted 30 days after account deletion
  • The User has this grace period to download their data

16. Age Restriction

The User must be at least 16 years old to use the platform (in accordance with GDPR Article 8). In the Republic of Serbia, the minimum age is 15 (in accordance with ZZPL Article 16). Persons below the applicable age threshold in their jurisdiction must not use the platform without parental or guardian consent.

17. Governing Law

These Terms are governed by the laws of the Republic of Serbia. For users located in the European Union, mandatory local consumer protection provisions shall remain applicable.

18. Force Majeure

We are not liable for service interruptions caused by events beyond our reasonable control, including natural disasters, wars, pandemics, widespread internet outages, or government actions.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be deemed modified to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

20. No Waiver

Birenko's failure to enforce any provision of these Terms shall not constitute a waiver of that right or provision. Any right or remedy under these Terms is cumulative and in addition to any other rights or remedies available under applicable law.

21. Changes to Terms

We may update these Terms from time to time. Non-material changes (e.g., wording clarifications, stylistic edits, addition of new features) take effect immediately upon updating the "Last updated" date, without separate notice. For material changes (those that affect fundamental rights or obligations of the User) we will provide 30 days' notice. Continued use of the platform after changes take effect constitutes acceptance of the updated Terms.
